Refund & Returns Policy
Effective Date: April 30, 2026
This Refund and Returns Policy (“Policy”) governs all redemptions, transfers, and deliveries of digital gift cards and any other rewards made available through the website operated by Earn and Trade LLC, a California limited liability company (“Earn,” “we,” “us,” or “our”). This Policy supplements, and is incorporated by reference into, our Terms and Conditions and Privacy Policy.
Please read this Policy carefully. By creating an account, accumulating points, or redeeming any reward through the Earn platform, you acknowledge that you have read, understood, and accepted the terms set forth below. If you do not agree with this Policy, you must refrain from redeeming any reward and from any further use of our services.
All Redemptions Are Final
Earn does not offer refunds, returns, exchanges, cancellations, or reversals of any redemption made through the platform. All point-for-reward exchanges are deemed final, irrevocable, and non-cancellable at the moment a digital gift card code, voucher, or comparable bearer instrument is generated, displayed to the user, or transmitted to the email address on file with the user’s account, whichever occurs first.
Important: Once a gift card code has been revealed, transmitted, or otherwise made accessible to you, the underlying value associated with that code is presumed to have been delivered in full. The code cannot be recalled, deactivated by Earn, or returned to your point balance for any reason except as expressly stated under “Limited Exceptions” below.
Nature of Earn Rewards
Earn operates a rewards-based loyalty program. Users accumulate points through promotional activities (including, but not limited to, completing offers, surveys, free trials, brand interactions, cashback shopping, and referrals) and may exchange those points for digital gift cards or other rewards offered through the platform. Points and rewards distributed through the Earn platform are subject to the following characteristics:
1. Promotional Consideration
Users do not purchase points or rewards from Earn with cash, credit, debit, or any other form of monetary consideration. Points are awarded as a promotional incentive in connection with the activities outlined above and have no independent cash value, no fair market value, and no monetary equivalent. Because no purchase transaction occurs, traditional refund mechanisms applicable to consumer goods or services do not apply.
2. Bearer-Instrument Character of Gift Cards
Each digital gift card issued through the Earn platform consists of an alphanumeric code (and, where applicable, an associated PIN) issued by a third-party merchant or its processor. These codes function as bearer instruments: any person in possession of the code can apply, redeem, or otherwise use the underlying value at the issuing merchant. Earn cannot retrieve, invalidate, or reverse a code once it has been displayed or transmitted, because the code is at that point in the custody and control of the bearer.
3. Third-Party Issuance
Gift cards delivered through the Earn platform are issued by independent third-party merchants and are subject to those merchants’ own terms, conditions, expiration provisions, balance-disclosure rules, and consumer-protection commitments. Earn acts solely as a facilitator of the redemption transaction and is not the issuer of the gift card. Once a code is delivered, all post-delivery obligations — including, without limitation, redemption, balance inquiries, replacement of lost or stolen codes, and dispute of merchant-side errors — rest with the issuing merchant.
Point of Irrevocable Issuance
For purposes of this Policy, a redemption is deemed irrevocable upon the earliest to occur of the following events:
The moment the gift card code is rendered or revealed within the user’s account dashboard, redemption confirmation page, mobile-application interface, or any other surface where the code becomes legible to the user.
The moment Earn (or its delivery vendor) sends an electronic message — including email, push notification, SMS, or in-app message — that contains, references, or makes retrievable the gift card code, regardless of whether the user actually reads, opens, or downloads the message.
The moment the issuing merchant or its processor activates, registers, or otherwise marks the underlying gift card as live within the merchant’s redemption systems, irrespective of whether the user has yet attempted to redeem the code.
Following any of the foregoing events, the redemption shall be conclusively presumed to have been completed, and Earn shall have no obligation, statutory or contractual, to reverse the transaction, restore points to the user’s account, or issue a substitute reward, except as set forth in “Limited Exceptions” below.
Limited Exceptions
Notwithstanding the general “all sales final” rule above, Earn will, in its sole and reasonable discretion and to the extent required or permitted by applicable law, consider the restoration of points or the issuance of a replacement gift card in the following narrowly defined circumstances:
1. Verified Technical Failure of Delivery
If the user can demonstrate, through Earn’s internal logs or independent corroborating evidence, that no gift card code was generated, displayed, or successfully transmitted as a result of a verifiable failure of Earn’s systems or those of its delivery vendor — and the user has not received and is not in possession of any usable code — Earn may, at its election, restore the affected points to the user’s account or arrange for a substitute redemption.
2. Confirmed Issuer-Side Defect
If the issuing merchant confirms in writing that the specific code delivered to the user was non-functional at the moment of delivery — meaning the code was never validly activated, was issued in error, or had been previously redeemed by another party prior to issuance to the user — Earn will work in good faith with the issuer to obtain a replacement code or, where that is impracticable, restore points to the user’s account.
3. Unauthorized Account Access
If a redemption was initiated by an unauthorized third party who obtained access to the user’s account without the user’s knowledge, consent, or negligent contribution, and the user reports the unauthorized activity to Earn within seventy-two (72) hours of its occurrence, Earn will conduct an investigation and may, where the facts support it, restore points or arrange for a replacement reward. Restoration is not guaranteed and is conditioned on the user’s full cooperation with Earn’s security team.
Important: The user remains responsible for safeguarding account credentials. Sharing a password, reusing a password from a compromised service, or failing to enable available security features may, at Earn’s discretion, disqualify a redemption from this exception.
4. Material Mistake of Fact at Issuance
In the rare event that Earn’s pricing or denomination engine displays a manifestly incorrect point cost, denomination, or merchant association at the moment of redemption — and the user could not reasonably have been unaware of the error — Earn reserves the right to void the affected redemption, restore the original point balance, and decline to deliver the erroneously listed reward, all without liability. This provision exists to protect the integrity of the rewards economy and is not intended to disadvantage users acting in good faith.
No exception applies where the user has redeemed, partially redeemed, transferred, sold, attempted to sell, gifted, lost, misplaced, photographed and shared, or otherwise voluntarily disclosed the code to any third party. The foregoing list is exhaustive: any circumstance not enumerated above shall not give rise to a refund, reversal, or replacement obligation on the part of Earn.
How to Report an Issue
If you believe one of the Limited Exceptions applies to your redemption, you must promptly submit a written report to Earn’s support team. Time is of the essence, and delayed reports will significantly reduce Earn’s ability to investigate and may render an exception unavailable.
1. Reporting Window
All reports must be submitted within seventy-two (72) hours of the redemption event for unauthorized-access claims, and within fourteen (14) calendar days for delivery-failure or issuer-defect claims. Reports submitted outside these windows will be reviewed only at Earn’s sole discretion and only where compelling extenuating circumstances are documented.
2. Required Information
Each report must include, at minimum: (i) the email address associated with the user’s Earn account; (ii) the date and approximate time of the redemption; (iii) the merchant and denomination redeemed; (iv) the redemption identifier or order reference, if available; (v) a clear, factual description of the issue and the requested remedy; and (vi) any supporting screenshots, error messages, or correspondence from the issuing merchant. Incomplete reports may be denied or deferred pending receipt of complete information.
3. How to Submit
Reports may be submitted by emailing [email protected] with the subject line “Redemption Issue — <Order Reference>.” Please retain a copy of your submission and any acknowledgment received from Earn for your own records.
Investigation and Resolution Process
1. Acknowledgment
Earn will acknowledge receipt of a complete report within five (5) business days. Acknowledgment is not an admission of liability or a determination on the merits of the claim.
2. Investigation Timeframe
Earn will, in good faith, complete its investigation within thirty (30) calendar days of acknowledgment, except where third-party issuers, payment processors, or law-enforcement agencies are involved, in which case the timeframe may be extended for as long as reasonably necessary to obtain the required information.
3. Determination and Remedy
Upon conclusion of the investigation, Earn will communicate its determination in writing. Where Earn determines that a Limited Exception applies, the available remedies are limited to (a) restoration of the user’s point balance to the state immediately prior to the affected redemption; (b) issuance of a replacement gift card of equivalent denomination and merchant, subject to availability; or (c) such other remedy as Earn deems equitable in the circumstances. Cash refunds, monetary compensation, consequential damages, and incidental damages are categorically unavailable.
4. Final Determination
Earn’s determination is final, binding, and not subject to further internal review, except to the extent applicable law mandates an additional appeal mechanism. Nothing in this Policy is intended to limit or waive any right the user may have to pursue dispute resolution under the Governing Law and Dispute Resolution provisions of our Terms and Conditions.
Chargebacks and Payment Disputes
Because Earn does not collect any monetary consideration from users in exchange for points or rewards, no payment-card transaction occurs in connection with a redemption. Accordingly, traditional chargeback rights through a card issuer or payment processor are inapplicable to redemptions on the Earn platform. Any attempt to initiate a chargeback, dispute, or reversal through a third-party financial institution in connection with an Earn redemption will be deemed bad-faith conduct and may result in the immediate suspension or termination of the user’s Earn account, in addition to any other remedies available to Earn at law or in equity.
Prohibited Conduct and Fraud
Earn reserves the right, exercisable at any time and without prior notice, to refuse, void, or reverse any redemption — and to suspend or terminate any account — where Earn has a good-faith reasonable basis to believe that the redemption is connected to fraud, manipulation of the points economy, abuse of promotional offers, automated or scripted activity, multiple-account misuse, identity misrepresentation, or any violation of our Terms and Conditions. In such cases, Earn may withhold delivery of the gift card, freeze the disputed points pending investigation, or pursue any other remedy available at law or in equity, including referral to law enforcement and recovery of damages and reasonable attorneys’ fees.
Notice: A user whose account has been terminated for fraud or abuse forfeits all unredeemed points and any pending or in-flight redemptions, without compensation, refund, or right of restoration, to the maximum extent permitted by applicable law.
Statutory Rights and Consumer Protections
Nothing in this Policy is intended to, nor shall it be construed to, waive, limit, or exclude any non-waivable right that a user may have under applicable federal or state consumer-protection laws, including, where applicable, the Credit Card Accountability Responsibility and Disclosure Act of 2009 (CARD Act), the Federal Trade Commission Act, the California Consumers Legal Remedies Act, the California Civil Code provisions governing gift certificates (Cal. Civ. Code §§ 1749.45–1749.6), and any analogous state-law provisions. To the extent that any provision of this Policy is found by a court of competent jurisdiction to be inconsistent with a non-waivable statutory right, the provision shall be modified or severed only to the minimum extent necessary to render the remainder of the Policy enforceable.
Most state-law gift-certificate statutes apply only to gift cards purchased for monetary consideration. Earn’s gift cards are awarded as a promotional incentive and may, depending on jurisdiction, fall within a statutory exemption for promotional or loyalty rewards. Users in California and certain other states may have additional rights with respect to expiration, dormancy fees, and cash redemption of small balances; those rights, where applicable, are preserved.
Account Security and User Responsibility
Users are solely responsible for maintaining the confidentiality of their account credentials and for all activity that occurs under their account. Earn strongly recommends the use of unique passwords, enabling all available multi-factor or device-verification features, and reviewing redemption history regularly. Earn shall not be liable for any redemption initiated under valid account credentials, regardless of the actual identity of the person who initiated the redemption, except to the extent expressly provided under “Unauthorized Account Access” in the Limited Exceptions section above.
Modifications to This Policy
Earn reserves the right to modify, amend, supplement, or replace this Policy in whole or in part at any time, in its sole discretion. Modifications shall become effective immediately upon posting to the website, except that any modification that materially diminishes a user’s rights with respect to a then-pending redemption shall not apply to that pending redemption.
Material changes will be announced through reasonable means, which may include posting a revised Effective Date at the top of this Policy, in-application notices, or email notification to the address on file with the user’s account. The user’s continued use of the Earn platform following the posting of changes constitutes acceptance of the modified Policy.
Users are encouraged to review this Policy periodically. The version of the Policy in effect on the date of any given redemption shall govern that redemption, except as otherwise required by applicable law.
Governing Law and Dispute Resolution
This Policy and any dispute, claim, or controversy arising out of or relating to it (including its formation, interpretation, performance, breach, or termination) shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute that cannot be resolved through informal negotiation shall be subject to the dispute-resolution provisions set forth in Earn’s Terms and Conditions, including any binding-arbitration and class-action-waiver provisions contained therein, to the maximum extent permitted by applicable law.
Severability and Entire Agreement
If any provision of this Policy is held by a court of competent jurisdiction or arbitral tribunal to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to render it enforceable, or, if not capable of such modification, severed from this Policy, and the remaining provisions shall continue in full force and effect.
This Policy, together with the Earn Terms and Conditions and Privacy Policy, constitutes the entire agreement between the user and Earn with respect to the subject matter hereof and supersedes all prior or contemporaneous understandings, representations, or agreements, whether oral or written. No course of dealing, course of performance, or trade usage shall be deemed to vary the terms of this Policy.
No failure or delay by Earn in exercising any right, power, or privilege under this Policy shall operate as a waiver thereof, nor shall any single or partial exercise of any right preclude further exercise of any other right hereunder. Any waiver by Earn must be in writing and signed by an authorized representative of Earn to be effective.
